1. Eligibility and Accounts

You must meet the minimum age and other eligibility requirements under applicable law. If you are not legally able to agree to these Terms independently, you must obtain any required permission from a parent or legal guardian.

Some features require an account. You must provide accurate information, protect your login credentials, and notify us if you believe your account has been accessed without authorization.

2. Services and AI-Generated Results

Photeditor provides tools for generating images from prompts and editing uploaded images. Available models, features, processing times, and usage limits may change.

AI-generated results may contain errors, unexpected changes, or content similar to results generated for other users. You are responsible for reviewing results before using or distributing them. We do not guarantee that results will be accurate, unique, suitable for a particular purpose, or eligible for intellectual property protection.

3. Free Trial, Credits, and Payments

Eligible accounts may receive free trial credits. Trial credits are subject to eligibility checks and usage limits and are not an unlimited or automatically renewing allowance.

The applicable credit cost is displayed before you submit a request. Credits are reserved when processing begins and consumed upon successful completion. Reserved credits are returned when a request is marked as failed or canceled. Closing your browser does not cancel a running request.

Paid plans and credit purchases are currently unavailable. If we introduce them, prices, purchase conditions, and any applicable refund terms will be disclosed before purchase. References to paid-account storage below apply only when credit purchases become available.

4. Your Content and Permissions

You retain the rights you hold in images, prompts, and other materials you submit (“Input”). You confirm that you have the rights and permissions necessary to upload, process, and use that Input, including permission relating to another person’s image where required.

You grant Photeditor a limited, non-exclusive permission to host, reproduce, transmit, and process your Input and generated results (“Content”) as necessary to provide, secure, and support the Services. This includes processing by service providers acting on our behalf.

This permission does not transfer ownership of your Input to Photeditor. Your use of generated results remains subject to applicable law and third-party rights. Photeditor does not use your Content to train AI models.

5. Storage and Retention

For accounts that have not purchased credits, uploaded images and generated results are retained for 15 days from their respective upload or generation dates. After that period, they expire and are scheduled for deletion.

Once an account successfully purchases credits, images and results that have not already expired, together with future uploads and results, receive storage without a scheduled expiration date. This storage does not depend on maintaining an unused credit balance. A purchase does not restore content that has already expired or been deleted.

Storage remains subject to user deletion requests, account deletion, lawful content removal, and continued operation of the Services. Please download copies of content you wish to retain independently. If we discontinue storage services, we will provide reasonable advance notice and an opportunity to download content where practicable and legally permitted.

6. Prohibited Uses

You must not use the Services to:

• Violate applicable law or another person’s intellectual property, privacy, or other rights.
• Create or distribute sexual content involving minors or non-consensual intimate imagery.
• Commit fraud, impersonate others deceptively, or create misleading media intended to cause harm.
• Harass, threaten, or otherwise unlawfully harm another person.
• Bypass safeguards, exploit trial allowances through multiple accounts, or circumvent usage limits.
• Disrupt the Services, gain unauthorized access, or extract proprietary source code except where permitted by law.

We may reject requests, remove content, or restrict access when reasonably necessary to address violations, security risks, or legal obligations.

7. Availability and Termination

We may update, suspend, or discontinue features and may suspend or terminate access for violations of these Terms. Where appropriate and practicable, we will provide notice.

You may stop using the Services at any time. To request account deletion, contact service@photeditor.com. Related data is handled as described in our Privacy Policy.

8. Disclaimers and Liability

The Services are provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties of uninterrupted availability, accuracy, fitness for a particular purpose, and non-infringement.

To the extent permitted by law, Photeditor is not liable for indirect or consequential losses arising from use of the Services. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

9. Changes and Applicable Law

We may update these Terms and will publish the revised version with a new effective date. For material changes, we will provide additional notice where required by law. Changes will not override rights you have under mandatory applicable law.

These Terms are subject to applicable law, including any mandatory protections available in your place of residence. Please contact us first if you have a concern so that we can try to resolve it.
